Terms & Conditions

Website: nscreativesolutions.com
These Terms & Conditions ("Terms") govern your use of the NS Creative Solutions website and, when incorporated into an accepted quotation, proposal, or project agreement, our provision of creative services. Please read them carefully. By using the site, you agree to its website-use provisions. A paid project is formed only when the applicable proposal or order is accepted in the manner we specify; an enquiry form submission alone is not a booking or a purchase.
Service provider: NS Creative Solutions, operated by [INSERT REGISTERED BUSINESS/INDIVIDUAL LEGAL NAME], at [INSERT BUSINESS ADDRESS AND COUNTRY] ("we," "us," or "our"). Contact: hello@nscreativesolutions.com.
1. Our services
NS Creative Solutions provides creative services that may include children's-book illustration and publishing support, character design, game art and assets, 2D animation and motion graphics, branding and graphic design, web design and development, digital illustration and UI/UX, creator and streaming assets, and seasonal or custom creative campaigns.
The precise deliverables, style, number of concepts, formats, licences, milestones, and level of support depend on the written project scope. Website descriptions and illustrative examples are general information, not a promise that every service is included in every package.
2. Quotations, orders, and scope
We may request a brief, references, dimensions, intended usage, platforms, quantity, technical requirements, target date, and budget before preparing an offer. A quotation is an invitation to proceed, not an obligation to begin work. Work normally begins after the necessary written approval, required information, and any agreed initial payment have been received.
A written accepted proposal, invoice, statement of work, or separate signed agreement controls the specific project's pricing, scope, schedule, revision allowances, payment dates, licence rights, and deliverables. If one of those documents expressly conflicts with these general Terms, the more specific agreed written project terms prevail for that project.
Any material change in brief, additional character, extra page, platform change, new concept, functionality, or other out-of-scope request may require a revised quotation and written approval before work continues.
3. Prices, packages, and monthly services
Website package prices are presented in US dollars (USD) unless clearly stated otherwise. Displayed package prices describe the listed scope only and may be starting prices, flat-scope prices, or monthly charges, as indicated. Taxes, transaction fees, third-party licences, domain/hosting fees, printing, platform fees, advertising spend, and extra deliverables are not included unless expressly listed.
A Per Project package covers a defined one-off deliverable or set of deliverables. A Monthly Children's Book or other recurring package applies to the capacity, page allowances, active titles, supported services, and any exclusions confirmed in the applicable written plan. A monthly package is not automatically unlimited work, and unused capacity does not roll over unless the written agreement says it does.
We may update future website prices. A price change does not retroactively amend a project or billing period already agreed in writing, unless the agreement permits it or the parties agree otherwise.
4. Payment and invoices
Any advance payment, deposit, balance, instalment, or recurring billing arrangement will be specified before work begins. Invoices are due on the dates stated in the agreed proposal or invoice. Deliverables, editable source files, and commercial usage rights may be withheld until the payment applicable to them has cleared, to the extent permitted by law and the agreement.
If payment is overdue, we may pause further work after giving reasonable notice. The project schedule may need to be revised after payment or missing information is received. Where applicable, additional charges will be disclosed and agreed before they are incurred.
5. Delivery schedules and priority production
Any timeline is an estimate or a project-specific commitment only when explicitly confirmed in writing. We do not guarantee a universal number of delivery days across all packages. “Priority,” “fast-track,” or similar wording means prioritised scheduling or handling where available—not a guaranteed fixed turnaround.
Delivery timing depends on the scope, availability of reference materials, client feedback, approvals, revision requirements, third-party services, and matters outside our reasonable control. We will communicate meaningful changes to an agreed schedule. An urgent deadline must be discussed and accepted in writing before it is treated as binding.
6. Client responsibilities
You agree to provide accurate contact and project details, timely feedback, necessary permissions, appropriate reference files, and decisions reasonably required for the work. You are responsible for checking spelling, names, factual content, legal disclosures, brand claims, print specifications, and final material that only you can verify.
You must have the right to provide any manuscripts, images, character references, logos, fonts, personal data, or other third-party materials you send us. We may decline requests that appear unlawful, infringing, deceptive, or otherwise unsuitable.
7. Concepts, revisions, and approvals
A revision round means one reasonably consolidated set of feedback relating to the same agreed concept and original brief. Minor refinements can include modest adjustments to colours, details, layout, expressions, or other agreed features. Replacing the fundamental concept, adding new scenes or characters, rewriting a complete manuscript, or changing platforms may count as additional scope rather than a revision.
Revision allowances vary by package or proposal. Lower-cost packages may provide limited minor refinements, higher tiers may include a stated number of rounds, and an “unlimited revisions” benefit—where expressly offered—applies only within the agreed project scope, not to unlimited new concepts, new products, or open-ended redesigns. Feedback may need to be submitted together and within the agreed review process.
We may request written approval of sketches, style directions, proofs, and final deliverables. If new changes are requested after approval, we will explain any additional work or fee before proceeding. A final approved and delivered item is considered completed subject to any outstanding agreed corrections and applicable statutory rights.
8. Intellectual property and usage rights
You retain ownership of original client materials you lawfully supply. We and our licensors retain rights in pre-existing tools, templates, methods, software, stock elements, unused concepts, drafts, and other materials not expressly transferred in writing.
Rights in final approved deliverables are determined by the package and written agreement. Some packages may include personal-use rights, others a commercial licence, and some may include broader ownership or editable source files. No copyright assignment, exclusive licence, or transfer of our background intellectual property should be assumed unless expressly stated in writing. Where a licence or transfer has been agreed, it generally becomes effective once the corresponding fees have been paid, subject to the written terms and applicable law.
If third-party stock art, fonts, plugins, music, software, marketplaces, or platform assets are included, their own licence terms continue to apply and may not be transferable. We will identify material third-party licensing requirements that are part of the agreed scope.
9. Publishing, web, and third-party platform services
For book or publishing projects, we may prepare artwork, covers, interiors, or platform-ready files, but acceptance by Amazon KDP, another publisher, printer, distributor, app store, marketplace, or advertising platform is controlled by that provider's rules. We cannot guarantee a specific approval, print colour match, publication outcome, ranking, distribution result, or sales volume.
For web services, domain registrations, hosting, security subscriptions, website plugins, integrations, payment gateways, third-party accounts, content moderation, data backups, and ongoing maintenance are included only if specifically agreed. Third-party outages, price changes, account suspensions, and changes to third-party policies are outside our control.
10. Confidentiality and portfolios
Each party should use reasonable care with confidential business information received from the other in connection with a project and use it only for the agreed purposes, except where disclosure is authorised or required by law. This does not apply to information lawfully public, already known without restriction, independently developed, or obtained legitimately from another source.
We may ask to feature non-confidential finished work in our portfolio, case studies, or promotional channels. Confidential projects, unpublished manuscripts, personal information, and client-identifying endorsements will not be published without the appropriate permission or another valid basis. Any express publicity or non-disclosure provision in a specific agreement prevails.
11. Project pauses, cancellations, and refunds
If you wish to pause or cancel an agreed project, please notify us in writing. We will explain the status of completed work, costs already committed, deliverables that can be supplied, and any payment or refund position under the accepted project agreement and applicable law.
Unless otherwise agreed, work already performed and non-cancellable third-party costs may be chargeable to the extent permitted by law. Refunds of deposits or advance payments depend on the particular contract, what has been performed, any applicable cancellation rights, and local consumer law; no blanket “all payments are non-refundable” rule is imposed by this page. Where we cancel a project, we will address unperformed services and any payments owed under the agreement and law.
For monthly arrangements, the cancellation notice period, renewal method, billing date, and any pause/rollover provisions must be confirmed in the applicable written plan. [CONFIRM ANY STANDARD MONTHLY CANCELLATION NOTICE POLICY BEFORE PUBLISHING.]
12. Website content and acceptable use
Our website's layout, branding, text, mascot designs, images, and other studio-owned content are protected by applicable intellectual property laws. You may browse and share normal links to public pages. You may not systematically copy or republish our artwork, impersonate the studio, compromise website security, harvest contact information, or use the site for unlawful or abusive purposes.
Portfolio images may include work subject to client, collaborator, or third-party rights; their presence on our website does not grant permission to reuse them.
13. Warranties and limitations
We will use reasonable care and skill in delivering services described in an agreed project scope. Except for express commitments in a signed or accepted agreement and rights that cannot lawfully be excluded, website content, general estimates, and illustrative examples are provided for information without guaranteeing a particular commercial, aesthetic, traffic, publication, or revenue result.
To the fullest extent permitted by applicable law, neither party is responsible for indirect or consequential loss not reasonably foreseeable when the project agreement was made. Any agreed limitation of direct liability must be read together with the specific project agreement and applicable law. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including where applicable fraud, wilful misconduct, or other non-excludable statutory rights.
14. Events outside reasonable control
Neither party will be treated as in breach for delays caused by events beyond its reasonable control, to the extent permitted by law, if it takes reasonable steps to inform the other party and reduce the impact. If the disruption is prolonged, the parties should discuss revised milestones or an appropriate cancellation arrangement.
15. Governing law and disputes
We encourage clients to contact us first so we can try to resolve concerns promptly. If a formal dispute arises, the applicable law and courts or dispute-resolution method will be those stated in the accepted project agreement and any mandatory consumer-protection rules. For website-only matters not governed by a separate agreement, the intended governing jurisdiction is: [INSERT COUNTRY/STATE AND COURTS AFTER LEGAL REVIEW].
16. Changes to these Terms
We may update these Terms by publishing a revised version and date. New terms will apply to future website use and future engagements, subject to applicable notice and consent requirements. Changes do not automatically override a previously signed or accepted project agreement.
